TERMS OF SERVICE

Thank you for your interest in Wine Cloud Inc. By purchasing from Wine Cloud Inc, you agree to the following terms of service. If you do not agree with these Terms, please do not proceed. These policy's effect all purchases on LearnAboutWine.com and WineCloudInc.com. These policy's are in place inside of any or our events, off line transactions, and website transactions.

AGE CERTIFICATION

You certify that you are at least 21 years of age.

Alcohol cannot be shipped or sold to any person under the age of 21. All packages sent by Wine Cloud Inc. require an adult signature. We will not be able to refund any shipping charges if your package is returned to us due to the inability to secure an adult signature for the wine delivery. If you intentionally or unintentionally misrepresent your age in order to provide alcohol to a person under the age of 21, Wine Cloud Inc will prosecute you fully to the extent allowable by law.

PRICING and OVERALL POSITION

Shipping charges are not price matched, wine prices are not price matched, services will very. Our focus is to educate and inform consumers on new brands, top quality stories and up and coming offers and opportunities. If you feel you have been wronged in any way, please let us know and we will investigate your grievance. WAIVER OF LIABILITY

Wine Cloud Inc has no liability, inferred or implied in any way, with regard to anything associated with your transaction. By purchasing from us, you agree to hold harmless Wine Cloud Inc. for any and all complaints, regulatory discrepancies, risks, or merchantability of fitness claims. Wine Cloud Inc. or any of its shareholders or employees shall not be liable for any punitive or special damages as a result of any action or inaction on either the buyer or sellers’ part. All transactions are at the buyer’s own risk.

Wine Cloud Inc liability is limited to the greatest extent permitted to by LAW.

APPLICABLE LAW

You expressly agree through your purchase to be subject to jurisdiction and venue in the state of California, and to have any adjudication related to your transaction resolved in the federal or state courts of California. If any provision of this agreement, terms or conditions is unlawful, void or unenforceable, you agree to waive their unenforceable nature and be bound by said terms, which hold Wine Cloud Inc. harmless for any action arising out of your purchase.

DISCLAIMER

Wine Cloud Inc will make every effort to ensure that the information on this website is accurate and current; however Wine Cloud Inc systems are left to the shallows of some human error and it makes no and expressly disclaims all representations or warranties of any kind with respect to this website and its contents. Due to the fact that many transactions take place between purveyors and Wine Cloud Inc, we must reserve the right to change price and availability information without notice to cover human error.

Wine Cloud Inc disclaims all representations and warranties, including for example warranties of merchantability and fitness for a particular purpose. In addition, Wine Cloud Inc does not represent or warrant our partners or clients’ information accessible via this site is accurate, complete or current. Wine Cloud Inc nor any of its directors, employees or other representatives will be liable for damages arising out of or in connection with the use of this site. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.

PRICING

Wine Cloud has the right to refuse or cancel any orders placed for products and/or services listed at an incorrect price, or containing any other incorrect information or typographical errors. Wine Cloud Inc. shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. Credit will be issued immediately upon any order of cancellation and as a policy, we will inform you to the best of our ability.

REFUND/CANCELLATION POLICY

LearnAboutWine requires advanced payments to secure needed expenses. Due to the perishable nature and cost of our wine and food events, advanced payments are non-refundable and credit will not be issued.

Wine Cloud Inc Purchases of wine - once an order is placed or received (at any point in the process: orders may not have even been filled, shipped nor received for this policy to be applied) - a fee has been incurred in processing, receiving, ordering, shipping or other. A return of wine is conditional in that the wine was properly shipped back to us at the purchasers expense. If an order has been made and shipped, both the shipping to and shipping back are the responsibility of the purchaser. A restocking fee, and shipping fee will be assessed against the value of the purchase. Shipping fee is not limited as we are responsible to pay our shippers for all services provided. Your fee may be much larger than the agreed to shipping cost to the destination. A return shipping fee, box fee, handling fee, and restocking fee will be assessed on a case by case basis. Typically minimum shipping fee is $25 out and $25 back plus $5 box fee, and 20% restocking fee for returning the merchandise to inventory.

We reserve the right to not accept your return outside of 30 days. Vintages change, inventory changes, and storage of said wine is suspect that returning wine is difficult and sometimes impossible. We pay a premium for shipping insurance, so any issues based on shipping need to be handled with the shipping service we issued. We receive the right to ship with the best partner to make sure your product is handled in the best possible way. No wine items maybe returned if they are current inventory, a restocking fee maybe necessary if the product was issued from an outside vendor and they present us with restocking fees.

LEARNABOUTWINE TICKET POLICY

Please note: All ticket sales are final. NO REFUNDS OR CREDITS will be issued once you complete your registration. If you have a conflict with the date, you may choose to privately transfer your ticket to a friend, but LearnAboutWine will not issue full or partial refunds or credit towards future events.

WARNING and WAIVER OF RESPONSIBILITY

By signing up for a LearnAboutWine event you are stating that you are above the age of 21 and/or of legal drinking age. ID is required for all attendees. You are paying LearnAboutWine for an educational experience; you acknowledge that wine is a drug and will affect your performance of any machinery or vehicle. You agree not to drive if you are over the legal limit for alcohol consumption, or not feeling safe to drive. You agree to keep your consumption in-line with socially acceptable behavior and limit your portions to one tasting of each wine. In addition, you take responsibility for your actions prior to, during and following consumption of alcohol. You will not hold LearnAboutWine, partners, businesses, or associates of, nor Loft218 or any location, liable for your actions. You accept responsibility for your own actions and reactions to the wine being served. This serves as a legal posting, warning and request to protect you from yourself. A taxi can be called for you from any event (and will be a lot less expensive for you than any legal action or incident). We thank you for understanding our concern and passion for your protection and the protection of others.

RIGHT TO USE LIKENESS

Photographs are often taken at our events; we reserve the right to use pictures taken at our events for promotional purposes. Your picture may be taken, used, posted, and integrated into our LearnAboutWine database.

COPYRIGHT

All photographs and information given, taken, shared with, posted to, or unload to, this Wine Cloud Inc., can and will be used as our property and for our convenience. Photo credit may be given when appropriate, and omitted when necessary.

We respect all trademarks and intellectual property asks for others to do the same.
